By opening or using a product purchased from Dynamiq A/V, the purchaser agrees to be bound by the term and conditions of sale as set forth below. If you do not agree to the terms and conditions of sale, please discontinue use of the website.

Dynamiq A/V makes no warranty, either expressed or implied, of merchantability or fitness for any particular purpose, and none shall be implied by law.

Final determination of suitability of any item sold for the use contemplated by purchaser is the sole responsibility of the purchaser, and Seller shall have no responsibility in connection with such determination.

Dynamiq A/V will not be responsible for any consequential or incidental damages resulting from the sale, non-delivery, use or improper function of any equipment purchased from us. The responsibility, if any is imposed, of Dynamiq A/V in regard to any item purchased shall be limited to the monetary value of the merchandise purchased.

TERMS AND CONDITIONS FOR USED TRADE-INS

1. Consummation of Transaction. By agreeing to these Terms and Conditions, you have agreed to accept one of the following methods of payment to you for the item(s) you wish to have us purchase from you or provide you credit per the below.

a. Ownership of Item(s). You accept that once we initiate payment to you, whether it be via Electronic Fund Transfer, Check or via Credit (all explained below) we gain full and irreversible ownership of the item(s) you are selling or trading in, no returns are accepted. You accept that the transfer of ownership happens at the point we process payment to you, whether initiating or scheduling an Electronic Fund Transfer, writing a check to be sent or handed to you, or crediting your account, and does not depend on the payment or account details or address provided by you being correct or accurate, nor does it depend on the payment clearing in/to your account.

b. Electronic Fund Transfer. If you have provided us your Account (as defined below) information, you authorize us, to credit or debit the account(s) listed on the information you have provided to us (the “account”) in connection with processing transactions between you and us. We may rely upon the account information you provided to us. We may rely on the routing and account numbers you provided. You agree to comply with all applicable laws, rules and guidelines related to electronic funds transfers. We are not required to give you any notice of debits or credits to your account. We may make adjustments to your account whenever a correction or change is required. For example, if we make an error with respect to your account, you agree that we may correct such error immediately and without notice to you. Such errors may include, but are not limited to, reversing an improper credit to your account, making adjustments for returned items, and correcting calculation and input errors. I. It is your responsibility to ensure that the payment details, including account number and routing number or international payment details, are correct and accurate. c. Check Payable to You. If you choose to be paid the agreed-upon amount for your item in the form of a check made payable to you, delivered by first-class mail or via another carrier, (1) a check processing fee, as set forth on our site, per transaction will be deducted from the agreed-upon amount and (2) if the check is desired to be shipped via UPS, FedEx or other similar carrier (i.e., other than via first-class mail), then the cost for such shall also be deducted from the agreed-upon amount for the transaction.

d. Credit as a Form of Payment. If you choose to be paid the agreed-upon amount for your item in the form of a credit, you will receive an additional amount as set forth on our website above the agreed-upon amount. The credit amount will be shown in your account via the online account you have created.

2. Account, User Names and Passwords. You will be required to set up an account in order to access certain areas of the site. You must be 18 years of age or older to register for an account and only one (1) account is allowed per person.

a. You are solely responsible for maintaining the security and confidentiality of your account and any password you use to access the Service and you agree not to transfer your password, user name, account or the use of your account, to any third party. b. All registration and billing information provided must be true and accurate. Providing any untruthful or inaccurate information shall constitute a breach of these Terms of Use. By confirming your purchase at the end of the checkout process, you agree to accept and ship the item(s) requested.

3. Accounts. When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

a. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. c. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel accounts in our sole discretion.
